By accessing, viewing and/or using Eat at a Local´s digital platform you acknowledge that you have read, understood and agreed to be bound to the full Terms and Conditions, and to all applicable legislation.

IN CASE YOU DON´T AGREE WITH THE CURRENT TERMS AND CONDITIONS YOU SHOULD NOT USE Eat at a Local´s.

These Terms and Conditions can be changed and/or updated at any time, without the need of any pre-notice. Nevertheless, Eat at a Local´s assumes as a principle, although a non-binding one, the respect to timely publish any revision of the rules and principles inherent to this digital platform.

Eat at a Local´s, as mere intermediary between the Host and the Guest, has the main purpose of promoting gastronomic experiences within a spirit of shared universal flavours, in different environments and with a sense of openness to the differences of its Users.

Through Eat at a Local´s platform, the Host opens the doors of his home, his private space, motivated by a real passion to prepare and cook food of quality within a true atmosphere of «well-receiving».

With Eat at a Local´s the Guests are invited to experience unique menus at the most diverse tables and contexts, in the company of the authors of each of the meals being served.

Different Guests can participate in the same gastronomic experience simultaneously without the need of knowing each other, according to the number of bookings available and already booked. This possibility allows Guests heterogeneity at one and the same table, where everybody can share a common gastronomic experience in a familiar environment provided by the Host.

As a complement to each gastronomic experience, the Host can put at the Guest disposal the option of also booking different activities or other kind of experiences, providing this way a better environment and ambience when tasting (please consult all booking possibilities).

Whenever you access Eat at a Local´s platform and/or every time you book through it, you’re accepting all the rules covered by these Terms and Conditions, and assuming that you know and agree with all of them.

Thus, it is recommended that these Terms and Conditions are carefully read before using Eat at a Local´s platform.

Eat at a Local´s has the purpose of protecting all users personal data, recognizing, at the same time, their right to know what kind of collection methods are used as well as the mechanisms of data processing used when this digital platform is accessed.

The access, registration or utilization of Eat at a Local´s is conditioned to the acknowledge and full agreement of the “Privacy Policy”.

The use of Eat at a Local´s platform is strictly forbidden to users minor than 18 (eighteen) years of age. Eat at a Local´s reserves the right, whenever appropriated, to request proof of age ir order to verify the compliance with this rule.

In case Eat at a Local´s identifies the access and/or use of its platform by individuals under 18 (eighteen) years old, procedures will be taken to block the user access as soon as possible, and it will also seek for a fast and complete deletion of all personal data eventually provided by the user.

The registration of Guests minor than 18 (eighteen) years of age can be only allowed if authorized by their legal representatives. Eat at a Local´s will request for the corresponding evidence whenever it deems it necessary.

Experience(s) booked at Eat at a Local´s can only be provided to minors than 18 (eighteen) years old in case they are properly accompanied by their legal representatives all along the experience.

In addition to all legal rules automatically imposed by access, registration and use of the actual digital platform, Eat at a Local´s considers totally unacceptable and, for that reason, It is expressly forbidden:

• The misuse of Eat at a Local´s, specifically for illegal and non-authorized purposes;

• Direct contact, by any means, between Guests and Hosts in order to book any experiences available at Eat at a Local´s, being this platform the only interlocutor between Users in accordance with these terms;

• The promotion, authorization or mere consent to access the account to third-parties, since any opened account at Eat at a Local´s is personal and non-transferable. Eat at a Local´s does not take any responsability for the use of the account by third-parties;

• The violation of privacy, of a person’s good name and of the respect among Eat at a Local´s Users, specifically through the publishing and/or availability, by any means and/or supports, of any non-authorized content, as well as abusive, offensive, threatening, obscene, defamatory or manifesting any kind of discrimination, specifically, racial, sexual, political and/or religious. Eat at a Local´s does not take responsability for any eventual violation of the referred rights, and anyone who may feel injured should activate the proper judicial means;

• Improper, abusive or non-authorized use of Eat at a Local´s trademark.

Eat at a Local´s reserves the right to block the access to its digital platform, temporarily or permanently, to anyone who infringes the previously announced rules, without prejudice of civil and/or criminal liability.

At Eat at a Local´s, the Guest should only choose the experience(s) he wants to live through, by booking it/them.

Along with the gastronomicl experience, Eat at a Local’s main object and purpose, Hosts can offer other activities and complementary experiencies, giving the Guests the opportunity to widen the scope of their booking.

Eat at a Local´s is in charge of processing all bookings as well as redirecting them to the corresponding Hosts.

When the Guest is booking, it is requested the filling out and submission of a digital form available at Eat at a Local’s. That form should be fully filled out with the indication of the chosen experience, as well as with the Guest personal information considered relevant by Eat at a Local’s in each moment. (cf Privacy Policy).

We only transfer the strictly necessary data between Hosts and Guests in order to guarantee the accomplishment of the booked experience.

The price of the experience(s) is payed, totally and in advance, by the Guest, through the payment options offered by Eat at a Local´s.

Booking confirmation only occurs after good charge of the amount by Eat at a Local´s, so It is considered as a «pending booking» the period that goes from the digital booking submission to the confirmation of the corresponding payment.

The order of transference of the amount due to the Host for the confirmed booking will be efectuated by Eat at a Local´s within 3 (three) working days, maximum, after the date of the event.

Financial transactions provided for in this current item are conditioned to the effective concretization of the booked experience(s) and they are equally in compliance with the rules provided by the «Cancellation Policy» also provided for in item 9.

Payment processing services for Hosts on Eat at a Local’s are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”). By agreeing to these terms or continuing to operate as a Host on Eat at a Local’s, you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of Eat at a Local’s enabling payment processing services through Stripe, you agree to provide Eat at a Local’s accurate and complete information about you and your business, and you authorize Eat at a Local’s to share it and transaction information related to your use of the payment processing services provided by Stripe.

Hosts and Guests can cancel their booked experiences, taking into account the following:

• Effects on the Guest

  All bookings must be confirmed by the Host within 24 hours. If the booking is not confirmed within this prompt or if it is refused, the Guest won´t be charged.

  When the Guest cancels a booking:

  • Until 48 hours prior to the outset of the event, the Guest will be totally refunded with the price of the booking;

  • Between 48 hours and 24 hours prior to the outset of the event, the Guest will be refunded in 50% of the price of the booking;

  • Less than 24 hours prior to the outset of the event, the Guest won´t have the right to any kind of refund.

• Effects on the Host

  All bookings must be confirmed by the Host within 24 hours. The Host must make sure he confirms his bookings within the prompt in order to receive the payment.

  When the Guest cancels the booking:

  • Until 48 hours prior to the outset of the event, the Host will not receive the payment;

  • Between 48 hours and 24 hours prior to the outset of the event, the Host receives 50% of the price of the booking, less the applicable service fee;

  • Less than 24 hours prior to the outset of the event, the Host will receive the full price of the booking, less the applicable service fee.

  In case the Host cancels the booking, the Guest will be refunded with the total price of the booking.

To all financial transactions inherit to these bookings are added the legally established taxes, being equally apllicable the legal billing norms prevailling.

Regardless of the concern Eat at a Local´s has with reviewing and updating the information available in its digital platform constantly, It can not be atributable to it any responsability for eventual errors, omissions or punctual interruptions in its normal functioning.

Eat at a Local´s reserves the right, at any time and without pre-notice, to correct, modify, change, improve or make changes in its digital platform, specifically on its operating rules or services.

All suggestions to improve, correct or update Eat at a Local´s digital platform are always welcome and shall be considered in posterior reviews.

Eat at a Local´s still reserves the right to disable the current digital platform, or discontinue any content or resources without pre-notice, without the prejudice to be compliant with the rules established by the cancellation policy for all confirmed bookings, yet not experienced.

Eat at a Local´s tries to make sure that all services provided by the Hosts have high standards of quality.

To accomplish that, and without prejudice of other measures, Eat at a Local´s may represent itself at booked and confirmed experiences, either on its own initiative or by express and written request of the Host.

Eat at a Local´s visits are previously scheduled with the Host, resulting in a quality of services certification, which is registered in the Host’s profile and available to all Users.

Eat at a Local´s presence, either by its own initiative or by Host request, as well as the referred certification and its registration at the platform, are free.

The use of Eat at a Local´s digital platform is from the exclusive responsability of the respective User. Eat at a Local’s does not assume any responsability beyond the one that is expressly provided on these terms and conditions and other legal texts provided at the platform.

Eat at a Local´s, assumes itself as mere intermediary between the Host and the Guest, being only responsable for the efficient promotion and publicity of the registered experiences through its digital platform, as well as for the warranty of a correct registry, payment and booking confirmation.

The Guest is, by himself, the only responsable for the access, use and bookings made through this digital platform, assuming not only the responsability for the veracity and correction of data and information provided, for the bookings that are made, as well as for the risks that can be connected to the experience(s).

It still falls back on the Guest, the responsability to attend the experience(s) along with his eventual companions and, by the terms booked and confirmed; to behave in a correct and respectful way towards the Host and the other Guests that may be sharing that same experience.

Eat at a Local´s is not responsable for any anomalous reaction (namely allergic), contamination or intoxication of the Guests during the ingestion of foods served under the experience, and it can not be equally imputed to it any responsability for non-approval of the meals, for frustrated expectations or for insufficient concretization of other complementary services that were booked.

Eat at a Local´s is not responsable for the actual quality, freshness, conservation methods and other characteristics and proprieties of the food served in each experience; not equally falling back on it any responsability concerning space hygiene or materials used, for the full compliance with the confirmed booking or for the concretization of other complementary services.

Eat at a Local´s is not responsable for any action or omission assumed as illegal or socially condemnable, nor for any personal or patrimonial damage that may come, directly or indirectly from the experience, either in the sphere of the Guest and his companions, either in the Host’s. The ones who may feel injured should, therefore, activate the means they consider more appropriated to avoid less proper conducts that, in a certain way, will minimize the effects that may result from that.

The identification and confirmation by Eat at a Local´s of a misconduct, of any nature, by the Guest, his companions or by the Host, can determine the platform lock, without the need of pre-notice, which does not invalidate the eventual activation of the legal means assumed to be convenient for the specific case.
