This Privacy Policy, elaboraded on the terms and in compliance with the disposed on the General Data Protection Regulation ("GDPR"), describes how Eat at a Local´s, in the quality of controller, collects and processes our Users personal data and other information, distinguishing them between Host or Guest.

It is our purpose to protect all personal information provided by our Users, recognizing them, at the same time, the right to know what kind of collecting methods we use, as well as the mechanisms by which we process their personal data whenever the current digital platform is used.

Consent
Users consent to collect and process their personal data is indispensable to Eat at a Local’s (PLEASE, READ CAREFULLY THE CURRENT PRIVACY).

THE ACCESS, REGISTRATION OR UTILIZATION OF EAT AT A LOCAL´S IS DEPENDENT ON THE FULL ACCEPTANCE OF THE PRIVACY POLICY, AS WELL AS ON THE TERMS AND CONDITONS ESTABLISHED, SPECIFICALLY IN WHAT CONCERNS TO COLLECTING AND PROCESSING PERSONAL DATA (AS DESCRIBED BELOW).
Non-personal data / Personal data
By accessing the current Platform you may be providing two types of data, non-personal data and/or personal data.

Non-personal data consists of non-identifiable or anonymous information. Although this information is being provided by the User to Eat at a Local´s through the access to its digital platform, it does not allow the identification of the User in question. It is about information of technical nature, such as User’s behaviour inside the platform, the kind of operating system used, flux of clics or researched sites, browser’s version and keyboard language, screen resolution, among others.

Personal data consists of individually identifiable information (“Personal Information”). This information can identify or be susceptible of identifying an individual or even assuming a private and/or sensitive nature.

All collected personal data consists of personal information provided voluntarily by the platform Users.

In case Users connect a social network account to their registration at Eat at a Local´s platform, they can be, at the same time, providing the access to certain personal data, although not directly, to Eat at a Local, authorizing, this way, the respective storage and data processing to the ends established by this privacy policy. We remind you that the way social networks collect, store, use and disclose personal information is exclusively ruled by their corresponding policies, not having Eat at a Local´s any responsability relating to their privacy practices or respective confidentiality. In case Users don´t agree with these privacy practices used within social networks, we recommended you not to integrate yourself within this platform.
Personal Data Categories and Processing Purposes
1. Creating an account
  When you create an account at Eat at a Local's digital platform, you can be requested, among other, the following personal data: name, gender, date of birth, age, tax identification number, civil registration number, passport data, language, address, e-mail address, selected password, phone number, bank account details, credit card details, delivery and billing address, interests/preferences in the experiences available, request to receive marketing e-mails, photo.
  
  In order to confirm the user’s identity, it might be requested to upload the identification document.
  
  Eat at a Local's processes the referred personal data with the purpose to provide access to account functionalities; assure the compliance of the established contractual relashionship; provide advertisment material on the terms legally defined; as well as the purpose of analysing your interests for marketing campaigns.
2. Booking Experiences
  If you book a service or a product through our website or application, Eat at a Local's can request, among other, the following personal data: name, gender, date of birth, age, tax identification number, civil registration numberl, passport data, language, address; e-mail address; selected password; phone number; bank account details; credit card details; delivery and billing address; account data; the kind of service or product you want, quantity and price, as well as the date of purchase, respective fulfillment, modification or cancellation; interest/preferences in certain experiences available.
  
  Eat at a Local's processes the referred data with the purpose to provide for a service or a contratualized product, as well as to attend the platform Users, to be compliant with legal obligations, to effects of establishment, exercise or defense in a legal claim, as well as to marketing and statistical purposes or research.
3. Sortition
  Whenever a sortition is launched at the platform, Eat at a Local's will collect and process the following Users personal data: name, address, e-mail address, contractualized service(s) or product(s), winner selection, prize, answers to inquiry (if apllicable).
  
  Eat at a Local's processes the referred personal data with the purpose of organizing the sortition, informing about the winning User, delivering the prize to the winning User, organizing the event and marketing campaigns.
4. Health Data
  When the experiences available at the platform are booked/contractualized, Eat at a Local's can collect and process information about the health condition of its Users, in particular the Guest, such as, eventual pathologies, allergies or food restrictions.
  
  Health information is susceptible data on the terms of the disposed in GDPR. Eat at a Local's adopts all necessary measures to protect these susceptible data, according to the legally required.
  
  Subject to your express consent, Eat at a Local's collects and processes health data exclusivelly for the purpose of accomplishing the contract and booked experience(s), Users attendance (specially the Guest), compliance to legal obligations, establishment, exercise or defense of a legal claim and personalized marketing.
Minority
The use of Eat at a Local´s platform is expressly forbidden to Users minor than 18 (eighteen) years of age. Eat at a Local´s reserves the right to ask for the proof of age at any time in order to verify the compliance with this rule.

In case Eat at a Local´s identifies the access and/or utilization of the platform by minors than 18 (eighteen) years old, it shall take the necessary procedures to block such User as soon as possible, seeking also for a fast deletion of all personal data that he might have made available.

The subscription of Guests aged under 18 (eighteen) years old is only allowed when authorized by their legal representatives, and Eat at a Local´s can ask for the corresponding evidence whenever it deems it necessary.

Booked experience(s) at Eat at a Local´s can only be provided to minors than 18 (eighteen) years of age in case they are properly accompanied by their respective legal representatives during the whole experience.
Transfering Data
1. Transfering data between Users
  Eat at a Local´s can transfer, totally or partially, data provided by its Users with the purpose of fully complying with established contractual relationships.
  
  Guests and Hosts data can only be transferred between themselves according to the corresponding booked experience(s) relationship, and the Guest has only access to the respective Host’s data, and vice-versa, as strictly as necessary to a successful and full accomplishment of the established contractual relationship through the confirmed booking.
2. Data transference to other Service Providers
  Eat at a Local's can contractualize other external service providers, acting in the quality of Eat at a Local's subcontractors to provide certain services or products, websites service providers, managing or accounting service providers, marketing service providers or IT support service providers. By providing these services, these external service providers may have access and/or may process this digital platform Users personal data.
  
  We demand from our service providers the implementation and application of security measures to guarantee data privacy and the safety of all our platform Users.
3. Other recipients
  Eat at a Local's can transfer – according to the applicable Data Protection Law – personal data to authorities responsible for law enforcement, governmental authorities, lawyers, external consultants, or business partners. In case of business transfer, personal data can equally be object of transference.
4. Personal Data International Transfers
  Personal data that Eat at a Local's collects or receives from its Users can be transferred and processed by others located inside or outside the European Economic Area ("EEA").
  
  In countries are included those listed https://ec.europa.eu/info/law/law-topic/data-protection_en which provide an adequate level of personal data protection according to european data protection laws.
  
  US recipients are partially certified by the terms of UE-US Privacy Shield scheme and are thus recognized as having an adequate level of data protection according to european data protection laws.
  
  Other recipients can be located in other countries which don´t offer an adequate level of data protection according to european laws. In those cases, Eat at a Local's takes all the necessary measures to guarantee that transfers to outside the EEA will be protected in an adequate way, on the terms established by the applicable Data Protection Law.
  
  In respect to countries that don´t provide an adequate level of data protection, we base the transfer on appropriate security measures, such as contractual-type clauses adopted by European Commission or by a supervisor authority, approved conduct codes, accompained by binding and enforceable commitments assumed by the local host or approved certification procedures, accompanied by binding and enforceable commitments assumed by the recipient.
Processing Legal Basis
1. Eat at a Local´s collection and processing of personal data sustains itself on the following legal basis:
  - If the User has given his consent to process his personal data for one or more specific purposes;
  - If processing is necessary to accomplish the established contractual relationship with the Users;
  - If processing is necessary to comply with a legal obligation that Eat at a Local´s might be obligated;
  - If processing is necessary to defend Users safety and health or of some other individual, who, somehow, may have a direct or indirect intervention in the established contractual relationship;
  - If processing is necessary for marketing, statistical or research reasons.;
  - If processing is necessary to the exercise of public interest functons or to the exercise of public authority that Eat at a Local´s come to be invested;
  - If processing is necessary to effects of prosecution of legitimate interests or a third-party’s, except if prevailing your interests or fundamental rights and freedoms that demand personal data protection, specially if it is a child;

2. Eat at a Local´s can still process your susceptible personal data based on the following legal basis:

    Users guarantee that all data provided at Eat at a Local´s platform is true, complete and updated, assuming total responsability for the consequences, direct or indirect, of any false, incomplete or outdated information.
    
    The non-provision of personal data by Users or the lack of veracity, completeness or validity can unfeasable the accomplishment of the contractual relashionship in question, and it may not be possible, specifically, opening an account; booking experiences; and/or the accomplishment of the corresponding event. Nevertheless, unless otherwise stated, non-provision of personal data by the Users won´t incurre in any legal consequences for themselves.
Users Rights and respective exercise
After their consent in relation to a certain collection, processing and use of personal data, Users can change or revoke their consent at any time, with future effects, and should do so expressly and directly to Eat at a Local´s through the respective contacts.

In the terms legally provided, Users have the right (i) to request the access to their respective personal data, (ii) request for the corresponding rectification, (iii) request for its deletion, (iv) request for processing restraint, (v) request for data portability, (vi) oppose its processing (including opposing to profile definition), and (vii) not being subject to any automatized individual decision (including profile definition).

Eat at a Local´s platform can have links to other platforms or webpages.

Whenever Users activate those links they will be doing so at their entire responsability, being the respective use subject to the terms and conditions, as well as to privacy policies defined by each of those platforms and webpages.
Security
Eat at a Local´s adopts and aims to promote reasonable measures to keep the security and integrity of the collected data within the platform and to prevent non-authorized access to it, or its use by the means of general acceptance.
Marketing
Users accept expressly that Eat at a Local´s can use their respective contact data (specifically e-mail address and phone number) with the purpose of providing comercial and non-commercial material, as well as with the purpose to inform about events, gastronomic experiencies; and even to send advertising or other marketing materials.

When expressly authorized by Users, it can be collected images (photos or video) from the events, capturing the present. These images can be used by Eat at a Local´s to promote its services through publishing them at the platform, on social web or by any other advertising mean. Eat at a Local´s is only responsable for its postings, and it can not be inputed to it any responsability for postings or any unauthorized image disclosure produced by third parties.

Users can oppose themselves to the use of their personal data to marketing purposes, and should do so in a formal and direct manner to Eat at a Local´s through the respective contacts. This opposition produces its effects from the moment the User has declared it himself.
Payments
Eat at a Local´s can accept diferent payment methods, which are identified at the platform.

Eat at a Local´s reserves the right to change, unilaterally and without pre-notice On-line payment processors. The use of On-line payment processors is of total responsability and risk of its Users, incurring on them the duty to fully comply with the corresponding rules of utilization, especially in what concerns to specified restrictions on age. Users recognize that by using On-line payment processors they are fully assuming the risks inherit in those respective transactions.
Personal data storage period
Users personal data is stored during the whole time it is necessary to the accomplishment of the contractualized experience(s) in the case of Guests. In what respects to registered Hosts, such data will be available as long as the established contractual relashionship with Eat at a Local´s endures. After the experience(s) accomplishment or the terminus of the contractual relashionship, Eat at a Local´s will delete or make anonymous all personal data provided by its Users, unless there are storage legal obligations to comply with (such as, for example, to tax effects).

Eat at a Local´s may store identification, contact details and revealed preferences of its Users concerning the contratualized experience(s) for a period of 10 (ten) years after the respective collection, to the effects of marketing, unless there is formal opposition from their holders.

The storage of Users personal data can still occur if they are necessary for establishment, exercise or defense on a legal claim, and only in the need of the information itself.

Without prejudice of the exposed to this respect, and in the measure of possible, after the contractual relationship ceases, Eat at a Local’s commits itself to limit Users personal data processing to the purposes pointed out.

Eat at a Local´s does not guarantee, however, that third-parties who have had access to Users data delete such information on the terms herein defined.

Changes to Privacy Policy
The terms of this Privacy Policy rule the use of the current Platform.

Eat at a Local´s reserves the right to change this privacy policy at any time, so it is recommended that you read it frequently.

In case of any relevant modification, Eat at a Local´s will make an effort to post the corresponding pre-notice at the platform.

Any relevant modification in the Privacy Policy will enter into force in 7 (seven) days after it has been published at the platform.

In case Terms shall be modified in order to comply with any legal requirement, modifications can enter into immediatly, or as legally provided, without any pre-notice.
